I came here looking for an answer to whether there was a DirectX 9 that would run in Windows 10, and seeing what people have posted I thought I'd share my experience to-date. I upgraded Windows 8.1 Pro to Windows 10 Pro a few days ago, and all went well. Phoenix ran perfectly fine and there were no issues.
It may be significant to note that this was in a 32-bit environment (you can only do the Windows in-place upgrade if you don't change architectures). However, I also went to do a clean install Windows 10 Pro 64-bit and this is where problems hit. My DVD, which carries version 2.5, seemed to install perfectly OK (I said 'no' to the question about installing DirectX 9 as I figured DirectX 11.1, which comes with Windows 10, would be better). However, when I ran it up, I got a barrage of silly error messages. The first of which was 'Unable to create window.' There were 4 in all. For good measure, I also got a meaningless error dumped into the Windows Application Event Viewer log.
It turns out that Phoenix doesn't use DX11; it only uses 9. Unfortunately, you cannot install DirectX 9 on Windows 10, not the 64-bit version anyway: DirectX 9 is not compatible with Windows 10 and when you try to install it, you get a message to the effect that you're not running a supported OS and it refuses to install. So I tried downloading the 'version any to 5' version of Phoenix from the Phoenix website and it appeared to install OK.

However, when I ran it up, I got the same slew of errors. So I uninstalled Phoenix using 'Add or remove programs' and installed again, this time saying Yes to the question about installing DirectX 9 (it turns out that versions 9 and 11 can co-exist on the same box). This time the install failed: error 1721. I searched online for a solution and was told to find the DirectX installer in the Phoenix folder. Which I fuly did, but again it would not install due to OS incompatibilities. So the upshot seems to be that if you do the in-place upgrade to Windows 10 you'll be fine.
But don't try and install on a clean install of Windows 10 because you'll have problems with DirectX 9. Hope this saves some grief anyway, and sorry for the long first post! Good information.

Over this past weekend I installed the Win 10 upgrade on my desktop that was running Win 7 and my laptop that was running Win 8.1. Tested Phoenix on the desktop and it runs fine. Unrelated I did have a problem getting the correct graphics driver as the Win 10 upgrade loaded a generic Windows driver that didn't have high enough resolution for my monitor. Was able to download the updated driver from nVidia and all was good.

Have not yet tested Phoenix on my laptop but will report back here when I do. Norcalheli, when Win 10 came up for the first time after the upgrade I also had only one low-resolution monitor and the other one was dead. Immediately I noticed that there were 2 Windows updates, so I rebooted to finalise their installation and both monitors sprang into life without issue, and the driver had been updated automatically. It looks as though, if DX9 is present at the time of upgrade, it remains present but if you do a clean install then you can't install it.
The correct fix would be for Phoenix to release an update that uses at least DirectX 11.
